This Pri­va­cy State­ment describes how JonathanBerte​.com, a sub­sidiary web­site of Robo­vi­sion BV, with reg­is­tered offices at Foreeste­laan 88, 9000 Ghent, Bel­gium, com­pa­ny num­ber 0899613236 — here­after referred to as Robo­vi­sion,” we,” or us” — process­es your per­son­al data.

Per­son­al data is infor­ma­tion that relates to an iden­ti­fied or iden­ti­fi­able nat­ur­al per­son. As a con­troller, we endeav­or to process your per­son­al data in com­pli­ance with the Euro­pean Reg­u­la­tion (EU) 2016679, oth­er­wise known as the Gen­er­al Data Pro­tec­tion Reg­u­la­tion (GDPR). GDPR was adopt­ed into Bel­gian fed­er­al leg­is­la­tion by the Law of 30 July 2018.

Robo­vi­sion reports to the Bel­gian Data Pro­tec­tion Author­i­ty (DPA).

Per­son­al Data

Direct Mar­ket­ing

For this pur­pose, we process the fol­low­ing per­son­al data:

  • Iden­ti­fi­ca­tion and con­tact details: sur­name, first name, address and tele­phone number;
  • Per­son­al char­ac­ter­is­tics: lan­guage, etc;
  • Data relat­ed to occu­pa­tion and career.

The per­son­al data may be sup­ple­ment­ed with infor­ma­tion obtained from third-par­ty sources eg from social net­works such as LinkedIn.

If you are a client of Robo­vi­sion, the legal basis is our legit­i­mate inter­est (in par­tic­u­lar free­dom of entre­pre­neur­ship). If you are not a client of Robo­vi­sion, the legal basis is your consent.

Unless a legal reten­tion peri­od applies, the data shall be retained for a peri­od of 3 years after the last mean­ing­ful con­tact between us and you.

The ini­tial peri­od may be pro­longed sub­ject to your consent.

Cus­tomer Management

We process the fol­low­ing per­son­al data in the con­text of our cus­tomer man­age­ment activities:

  • Iden­ti­fi­ca­tion and con­tact details: sur­name, first name, address, tele­phone number;
  • Finan­cial data eg data relat­ing to payment;
  • Per­son­al char­ac­ter­is­tics such as language;
  • Data relat­ing to occu­pa­tion and career.

The per­son­al data may be sup­ple­ment­ed with infor­ma­tion obtained from third-par­ty sources eg from social net­works, such as LinkedIn, the Banque-car­refour des entre­pris­es data­base, etc.

The legal basis is con­trac­tu­al neces­si­ty and for some per­son­al data, our legal obligation.

Per­son­al data described above must be pro­vid­ed to enable the per­for­mance of the con­tract. If you do not pro­vide this per­son­al data, the con­tract may not be performed.

Unless a legal reten­tion peri­od applies, data shall be retained for a peri­od of 10 years after the end of the con­trac­tu­al relationship.

We process the fol­low­ing per­son­al data in the con­text of our cus­tomer man­age­ment activities:

Finan­cial data eg pay­ment data.

The legal basis is our legal obligation.

The data shall be retained for the dura­tion of the legal reten­tion period.

Sta­tis­ti­cal Purposes

We process per­son­al data in the con­text of the cre­ation of sta­tis­ti­cal mod­els. For each of these pro­cess­ing activ­i­ties, a spe­cif­ic pri­va­cy state­ment shall apply.

Recip­i­ents of Your Per­son­al Data

We might share your per­son­al data with oth­er recip­i­ents, such as:

  • Proces­sors which pro­vide us with services;
  • Nation­al and Euro­pean pub­lic authorities;
  • Finan­cial insti­tu­tions, insur­ance com­pa­nies and pay­ment ser­vice providers;
  • Our pro­fes­sion­al and legal advisers.

Your per­son­al data may be trans­ferred to coun­tries out­side the Euro­pean Eco­nom­ic Area (EEA)*. If the leg­is­la­tion of those coun­tries does not offer ade­quate pro­tec­tion, Robo­vi­sion will ensure the ade­quate pro­tec­tion of your per­son­al data by means of oth­er mech­a­nisms per­mit­ted under GDPR.

For the Unit­ed States of Amer­i­ca, Robo­vi­sion relies on the EU-US and Swiss-US Pri­va­cy Shield Frame­work and, or, both the EU Stan­dard Con­trac­tu­al Claus­es (SCC). For oth­er coun­tries, Robo­vi­sion relies on stan­dard con­trac­tu­al clauses.

Data Pro­cess­ing Rights of Per­son­al Data

Accord­ing to GDPR, you, as a data sub­ject, have the right:

  • Right to access and receive a copy of your data (Arti­cle 15);
  • Right to rec­ti­fy incor­rect data (Arti­cle 16);
  • Right to object to the pro­cess­ing for direct mar­ket­ing and for rea­sons relat­ed to your par­tic­u­lar situation;
  • Right to erase or restrict your data alias The Right to be For­got­ten’ (Arti­cle 17);
  • Right to retract data-pro­cess­ing con­sent at any time;
  • Right to data porta­bil­i­ty when the pro­cess­ing is based on con­sent or con­trac­tu­al obligation.

You have the right to lodge a com­plaint with to the Bel­gian Data Pro­tec­tion Author­i­ty (DPA) if you believe Robo­vi­sion has vio­lat­ed your rights as a data sub­ject. You can find a link in the bib­li­og­ra­phy below.

Imple­men­ta­tion of secu­ri­ty measures

Accord­ing to the applic­a­ble law, we have imple­ment­ed an ade­quate sys­tem of pro­tec­tion of your per­son­al data. These mea­sures include tech­ni­cal and orga­ni­za­tion­al mea­sures required to pro­tect your per­son­al data against the acci­den­tal or unau­tho­rized destruc­tion, loss, alter­ation, unau­tho­rized dis­clo­sure or access to your per­son­al data.

Nev­er­the­less, no secu­ri­ty sys­tem can guar­an­tee 100% secu­ri­ty. You also have a role to play regard­ing the secu­ri­ty of your data, which includes pro­tect­ing your user account data and choos­ing a strong pass­word.
